Immunity provides a protection against the prosecution of criminal offence. When surprising in the act immunity is not valid. Indemnity states that an Member of Parliament is not to be held responsible because of his voting behavior or statements made in parliament. In the present case however he speaks outside the Bundestag. Therefore neither indemnity nor immunity protect the Member of Parliament.
